Terms and Conditions

National AC Parts (referred to as "NACP / WE") entered into a formal agreement with EC Focus Pty Ltd, trading as Energy Conservation (referred to as "ECF") an Accredited Certificate Providers (ACP) under both the Energy Saving Scheme (ESS) and the Peak Demand Reduction Scheme (PDRS), as required by IPART ("the REGULATOR") to jointly participate in the delivery of ESS and PDRS activities on behalf of accredited New South Wales air conditioning installers ("INSTALLER / YOU").  

 

In summary, NACP agrees to conduct sales and/or installation activities (referred to as "APPLICATIONS") on all projects where the Installer intends to use the ACP to create ESCs and PRCs for an Original Energy Saver / Capacity Holder in accordance with all requirements of the ESS and PDRS.

 

Our (NACP) Responsibilities

By participating, we agree that; (i) you have access to the National AC Parts app ("the APP"); (ii) you have access to the EC Focus calculator; (iii) provide training and assistance to the Installer and their personnel; (iv) provide the ACP with full, true, authentic, and accurate ESS & PDRS related activity records in a timely manner; (v) Co-operate with auditors reviewing works completed under the ESS & PDRS and respond to their requests in a timely manner.​

Your (INSTALLER) Responsibilities
By participating, you agree that you; (i) are over 18 years old; (ii) hold an Unrestricted Electrical Work Licence for New South Wales, Australia or have a business relationship with a person who does; (iii) have a valid Australian Business Number (ABN), and (iv) have public liability insurance cover of at least $5 million.

 

Our App

The App is owned by CR Marine Pty Ltd (Parent of National AC Parts) and its affiliates, and all content therein are the exclusive property of CR Marine Pty Ltd.


You will ensure any information about you, including your contact details, is true, current and complete. If your information changes, you must update it by emailing National AC Parts. If you provide false, inaccurate or misleading personal details, CR Marine Pty Ltd may immediately limit your access to the National AC Parts app without prior notice to you.

You are responsible for maintaining the security of your app details. We will not take responsibility for unauthorised access and use of. If you consider an Application made was not made or otherwise authorised by you, you should contact us and we will investigate this as an unauthorised activity. In the absence of such a request from you, you acknowledge and agree that we will treat any such Application on the app as a valid submission.

Your HEER Applications
It is your responsibility to ensure that the Application details are correct before submitting. Any information or claim that you provide about the Application, its products or services at any time including up to the completion of the audit, must be accurate, truthful and based on reasonable grounds. This includes;

  • Tax Invoices

  • Proof of Payments

  • Supporting Images 

  • Mandatory recycling and disposal requirements for equipment replaced by energy saving / peak demand reducing equipment.

 

If you are found to be providing false claims and/or misleading impressions, you must reimburse any amounts paid by NACP in relation to the misleading application. In the event of, NACP will; (i) will notify the ACP in writing within seven (7) days; (ii) immediately limit your access to the National AC Parts app without prior notice to you.; and (iii) provide all submitted documents to the appropriate authorities for further investigation or review.

 

Any fines, sanctions, penalties or otherwise from a government agency or authoritative body, arising from false claims and/or misleading impressions or relating to work undertaken by the Installer, the Installer indemnifies NACP and ECF, and holds them harmless, for any loss or liability arising from the fine, sanction, penalty or otherwise, including any Claims for indirect or consequential loss.

You agree to cooperate with NACP with any support, assistance, materials including supporting documentation and customer contact details which are reasonably required for the Application and the audit of the Application.


All Applications are subject to our approval – for example, if the Application does not meet the required criteria or if NACP believes the Application will not result with a successful audit, we will cancel the Application and provide a written explanation for the cancellation to you.

 

ECF Estimated Rebates

Estimated rebates are provided by ECF via the EC Focus Calculator based on current value of the Energy Certificate. The EC Focus Calculator updates monthly and therefore any potential Applications that may fall in the following month should be re-checked. The final rebate paid is based on the Energy Certificate value at the time of the completed audit and therefore may change from the estimated rebate presented in the EC Focus Calculator at the time of the Application.

ECF Audit

All reasonable care is taken during the audit of the Application and thus the audit process may take up to thirty (30) days from the date all supporting documentation has been submitted. During this period, NACP will co-operate with auditors reviewing works completed under the ESS & PDRS and respond to their requests in a timely manner.


Your Invoices
You will receive an email notifying you of a successful audit, and the request for an invoice for payment of the rebate. All invoices are to; (i) be made to National AC Parts; (ii) state the amount to be paid (less the Administration Fees); (iii) state the Goods and Services Tax (GST); and (iv) complete details of the Application name and number (provided in the notifying email). The invoices are to be emailed to accounts@nationalacparts.com.au for processing.

 

Any outstanding invoices issued by NACP to the Installer for products purchased will be deducted from any rebates before payment is made by NACP.

Our Communication
Agreements, notices or other communications regarding use of the App may be provided to you by email, SMS and/or phone. You agree to receive all communications from us in these forms using the contact details you have provided to us. We will also contact you on an ongoing basis for marketing purposes whether by email, SMS, phone or otherwise (unless you have notified us that you do not wish to receive such communication). You can contact us when required by emailing info@nationalacparts.com.au.

Your Privacy
All information that is collected about you and/or your Applications including information collected in connection with the verification of your identity and the Application, will be collected, used and stored in accordance with the National AC Parts Privacy Policy. You agree for us (or any third parties providing services on behalf of National AC Parts) to disclose to third parties, to the extent required by any applicable laws or regulations, any information in relation to you, your Application or your National AC Parts Account.

Our Intellectual Property
You must not copy, imitate, modify, alter, amend or use without our prior written consent any URLs representing website and mobile applications owned by CR Marine Pty Ltd, National AC Parts and its affiliates, or any of our content, logos, graphics, icons or other content published on these platforms or in our printed media.

We reserve the right to change the functionality, terms, conditions, and notices under which the App owned by CR Marine Pty Ltd is offered.

System Outages
Access to the App may occasionally be unavailable or limited due to hardware or software failure or defects, overloading of system capacity, damage from natural events or disasters or disruptive human activity, interruption of power systems, labour shortages or stoppages, legal or regulatory restrictions as well as other causes outside of our control.

To the extent permitted by law, we will not be liable for any loss or damage which you may incur as a result of the website being unavailable.

Governing Law and Jurisdiction
This Agreement is governed by the law in force in Queensland, Australia. Each party irrevocably submits to the non-exclusive jurisdiction of courts exercising jurisdiction in Queensland, Australia.

By participating, you agree to be bound by (i) these Terms and Conditions; (ii) National AC Parts Privacy Policy (iii) Energy Conservation Terms and Conditions; (iv) HEER (IPART) Requirements. If you do not want to be bound by this Agreement, you must not participate in the NSW HEER Scheme as provided by National AC Parts.
